Many of our clients are from international families whose lives and financial affairs span a variety of countries. In particular we have links with the United States (especially Texas, New York, Washington DC, California, Florida, & Chicago) Canada, Dubai, Kuwait, Abu Dhabi, Bahrain, Scotland, Ireland, France, Spain, Germany, Netherlands & Italy.
We are able to help when a client is facing separation or divorce and there is a connection to England. This is either usually because the family has assets or property in England, or that they, or their spouse, may have been living in England for a period of time.
We have links with many lawyers all around the world, especially in the countries and areas above, with whom we have good working relationships and can work with them as a team to ensure the advice our client receives covers all the relevant jurisdictions.
Determining which jurisdiction is best for a divorce and financial settlement
We can work with lawyers in all the jurisdictions that are relevant to you to assist you in deciding which location is more favourable to you to issue divorce and financial proceedings. We can advise on the outcome of proceedings in England and then compare that with advice from lawyers in other relevant jurisdictions.
We can work with your lawyers and tax advisors in other relevant jurisdictions to ensure that any settlement is compliant with all necessary tax rules and is enforceable in each relevant jurisdiction.
Relocation of children to other jurisdictions at the end of a relationship
Children can only move to another country with the consent of both parents or a court order if one parent does not agree. We can advise on the chances of success if you wish to consider a relocation of your children abroad following the breakdown of your relationship. Or alternatively how to seek to prevent such relocation if you wish them remain in England. We can advise how best to maintain your relationship with your children if you are living in a different country to them.
International abduction of a child by a parent
We can deal with the emergency situation of trying to prevent the abduction of a child by a parent or to secure their return in the event this has already occurred.
Pre and Post nuptial agreements
These are agreements made prior to the marriage or during the course of the marriage to regulate what is to happen in the event of your marriage breaking down. They are particularly useful where there are children from a previous marriage or relationship and there are assets you wish to preserve for them, or to deal specifically with inheritance or family gifts received prior to or during the marriage. We can assist in making sure any agreement is compliant and to be used in both England and in any other relevant jurisdiction by working with lawyers in those jurisdictions.
